{"id":2359,"date":"2020-04-28T11:16:47","date_gmt":"2020-04-28T11:16:47","guid":{"rendered":"http:\/\/www.confida.rs\/rs\/?p=2359"},"modified":"2020-05-29T07:11:41","modified_gmt":"2020-05-29T07:11:41","slug":"covid-19-radnopravna-pitanja","status":"publish","type":"post","link":"https:\/\/www.confida.rs\/rs\/covid-19-radnopravna-pitanja\/","title":{"rendered":"COVID-19: Radnopravna pitanja i obaveze poslodavaca"},"content":{"rendered":"<h1>Sadr\u017eaj &#8211; COVID-19: Radnopravna pitanja i obaveze poslodavaca<\/h1>\n<ul>\n<li><a href=\"#kori\u0161\u0107enje-godi\u0161njeg-odmora-u-uslovima-vanrednog-stanja\">Kori\u0161\u0107enje godi\u0161njeg odmora u uslovima vanrednog stanja<\/a><\/li>\n<li><a href=\"#uredba-o-organizovanju-rada-poslodavaca-za-vreme-vanrednog-stanja\">Uredba o organizovanju rada poslodavaca za vreme vanrednog stanja<\/a><\/li>\n<\/ul>\n<h2 id=\"kori\u0161\u0107enje-godi\u0161njeg-odmora-u-uslovima-vanrednog-stanja\">Kori\u0161\u0107enje godi\u0161njeg odmora u uslovima vanrednog stanja used\u00a0<a style=\"font-size: 16px;\" href=\"https:\/\/www.confida.rs\/rs\/covid-19\/\">COVID-19<\/a><\/h2>\n<p>Vlada Republike Srbije je objavila zaklju\u010dak u vezi sa kori\u0161\u0107enjem godi\u0161njeg odmora u uslovima vanrednog stanja. Zakonom o radu je propisano da ako zaposleni koristi godi\u0161nji odmor u delovima &#8211; prvi deo koristi u trajanju od najmanje dve radne nedelje neprekidno u toku kalendarske godine, a ostatak najkasnije do 30. juna naredne godine.<\/p>\n<p>U zavisnosti od mogu\u0107nosti i vrste radnog anga\u017eovanja zaposlenih u uslovima vanrednog stanja, u Zaklju\u010dku Vlade Republike Srbije su date dve preporuke i jedna obaveza u vezi sa kori\u0161\u0107enjem godi\u0161njeg odmora za zaposlene:<\/p>\n<p>1) Preporu\u010duje se poslodavcima da zaposlenima koji imaju obavezu redovnog obavljanja radnih zadataka, omogu\u0107e kori\u0161\u0107enje dela godi\u0161njeg odmora za 2019. godinu, zaklju\u010dno sa 31. decembrom 2020. godine.<\/p>\n<p>2) Zaposlenima kojima je omogu\u0107en rad na daljinu i rad od ku\u0107e, poslodavac je du\u017ean da omogu\u0107i kori\u0161\u0107enje dela godi\u0161njeg odmora za 2019. godinu zaklju\u010dno sa 30. junom 2020. godine.<\/p>\n<p>3) Preporu\u010duje se poslodavcima, koji u uslovima vanrednog stanja nisu u mogu\u0107nosti da organizuju proces rada, pri upu\u0107ivanju zaposlenih na odsustvo sa rada, u skladu sa zakonom, prednost daju kori\u0161\u0107enju godi\u0161njih odmora zaposlenih.<\/p>\n<h2 id=\"uredba-o-organizovanju-rada-poslodavaca-za-vreme-vanrednog-stanja\"><a href=\"http:\/\/www.pravno-informacioni-sistem.rs\/SlGlasnikPortal\/eli\/rep\/sgrs\/vlada\/uredba\/2020\/31\/2\/reg\">Uredba o organizovanju rada poslodavaca za vreme vanrednog stanja<\/a><\/h2>\n<p>Dana 16. marta 2020. godine usvojena je Uredba o organizovanju rada poslodavca za vreme vanrednog stanja (\u201eUredba\u201c) kojom su regulisane osnovne nedoumice poslodavaca u privatnom sektoru koje se odnose pre svega na na\u010din i organizaciju rada za vreme vanrednog stanja.<\/p>\n<p>U tom smislu Uredba predvi\u0111a slede\u0107e osnovne novine:<\/p>\n<ul>\n<li>Poslodavac je du\u017ean da omogu\u0107i rad od ku\u0107e svim zaposlenima kod kojih je to mogu\u0107e, a na na\u010din regulisan ugovorom o radu ili op\u0161tim aktom;<\/li>\n<li>Ukoliko mogu\u0107nost rada od ku\u0107e nije regulisana ugovorom o radu ili op\u0161tim aktom poslodavci takav rad mogu uvesti dono\u0161enjem re\u0161enja, pod uslovom da mu to organizacioni uslovi dozvoljavaju.<\/li>\n<li>Re\u0161enje o radu od ku\u0107e mora da sadr\u017ei radno vreme i na\u010din kontrolisanja rada zaposlenih.<\/li>\n<\/ul>\n<p>Isti\u010demo da je shodno odredbama Uredbe regulisano da poslodavci moraju da vode evidenciju zaposlenih koji rade od ku\u0107e, kao i da obezbede ostale mere koje se odnose higijensku sigurnost objekata predvi\u0111ene Zakonom o za\u0161titi stanovni\u0161tva od zaraznih bolesti. To zna\u010di da za zaposlene i radno anga\u017eovane, koji su u neposrednom kontaktu sa strankama ili dele radni prostor sa vi\u0161e lica, potrebno je obezbediti dovoljne koli\u010dine za\u0161titne opreme u skladu sa posebnim propisima.<\/p>\n<p>Uredbom je predvi\u0111eno da poslodavci koji ne mogu organizovati rad od ku\u0107e zbog prirode svoje delatnosti moraju da usklade svoje poslovanje sa uslovima vanrednog stanja:<\/p>\n<ul>\n<li>Da ukoliko je to mogu\u0107e i ukoliko ne iziskuje dodatna sredstva organizuju rad u smenama kako bi \u0161to manji broj zaposlenih i drugih radno-anga\u017eovanih lica obavljali posao istovremeno u jednoj prostoriji;<\/li>\n<li>Omogu\u0107i odr\u017eavanje svih poslovnih sastanaka elektronskim putem (video link, video poziv itd.);<\/li>\n<li>Da odlo\u017ei slu\u017ebene puteve u zemlji i inostranstvu u skladu sa odlukom nadle\u017enog organa o zabrani, odnosno privremenom ograni\u010denju ulaska i kretanja.<\/li>\n<\/ul>\n<p>Isti\u010demo da jo\u0161 uvek nisu posebno regulisana ostala otvorena pitanja kao \u0161to su:<\/p>\n<ul>\n<li>na\u010din naknade zarada zaposlenih koji su upu\u0107eni na odsustvo naredbom poslodavca a radi spre\u010davanja \u0161irenja zaraze, kao i<\/li>\n<li>na\u010din naknade zarade zaposlenima u izolaciji i samoizolaciji, kao i obolelih.<\/li>\n<\/ul>\n<p>U tom smislu za sada primenjuju se op\u0161te odredbe <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_radu.html\">Zakona o radu<\/a> kao i <a href=\"http:\/\/www.zso.gov.rs\/doc\/dom-p\/zdr-os\/Zakon%20o%20zdravstvenom%20osiguranju2.pdf\">Zakona o zdravstvenom
