{"id":2155,"date":"2019-07-26T12:15:21","date_gmt":"2019-07-26T12:15:21","guid":{"rendered":"http:\/\/www.confida.rs\/rs\/?p=2155"},"modified":"2020-06-10T11:19:53","modified_gmt":"2020-06-10T11:19:53","slug":"nacrt-zakona-o-agencijskom-zaposljavanju","status":"publish","type":"post","link":"https:\/\/www.confida.rs\/rs\/nacrt-zakona-o-agencijskom-zaposljavanju\/","title":{"rendered":"Nacrt Zakona o agencijskom zapo\u0161ljavanju"},"content":{"rendered":"<p>Stigao je novi <a href=\"https:\/\/www.paragraf.rs\/dnevne-vesti\/061118\/061118-vest11.html\" target=\"_blank\" rel=\"noopener\">Nacrt Zakona o agencijskom zapo\u0161ljavanju<\/a>, gde \u0107e rad preko agencija \u0107e biti ograni\u010den na 24 meseca, a zaposlenima \u0107e na ovaj na\u010din omogu\u0107iti isplatu zarade, bolovanja, regresa, toplog obroka, prevoza. Radnik preko agencije ima\u0107e pravo da konkuri\u0161e za posao u radni odnos kod tog poslodavca<\/p>\n<p>Trenutno u Srbiji ima oko 100.000 ljudi koji rade za preko vi\u0161e od 100 agencija koje se bave privremenim zapo\u0161ljavanjem, a da taj rad nije regulisan nijednim zakonom.<\/p>\n<p>Radnici na koji rade preko svoje agencije zakonski nemaju pravo na godi\u0161nje odmore i bolovanja, ali ni na tople obroke i naknadu za prevoz, i sve se interno dogovara sa poslodavcem. Ministarstvo rada, zapo\u0161ljavanja, bora\u010dkih i socijalnih pitanja ve\u0107 tri godine na sastancima radne grupe, formirane da se uredi taj Zakon. I \u201epau\u0161alcima\u201c radnicima da jednaka prava kao i onima koji prema <a href=\"https:\/\/www.paragraf.rs\/propisi\/zakon_o_radu.html\" target=\"_blank\" rel=\"noopener\">Zakonu o radu<\/a> (&#8220;Sl. glasnik RS&#8221;, br. 24\/2005, 61\/2005, 54\/2009, 32\/2013, 75\/2014, 13\/2017 &#8211; odluka US, 113\/2017 i 95\/2018 &#8211; autenti\u010dno tuma\u010denje) rade na odre\u0111eno ili neodre\u0111eno kod poslodavca.<\/p>\n<p>Radnici \u0107e po usvajanju Nacrta zakona o agencijskom zapo\u0161ljavanju mo\u0107i da rade na odre\u0111eno i neodre\u0111eno, zasniva\u0107e radni odnos u agenciji, a ne\u0107e biti zaposleni na osnovu nekakvih ugovora o privremenim i povremenim poslovima kao \u0161to je to sada. Rad preko agencija \u0107e, kao i do sada, biti ograni\u010den na 24 meseca, a zakon \u0107e zaposlenima na ovaj na\u010din omogu\u0107iti isplatu zarade, bolovanja, regres, topli obrok, prevoz. Osim toga, napominje Peta\u010d, radnik preko agencije ima\u0107e pravo da konkuri\u0161e za posao kod tog poslodavca i ne\u0107e morati da pla\u0107a procenat agenciji kao \u0161to je to sada slu\u010daj. \u2013 saop\u0161tava Melanija Peta\u010d, \u010dlanica radne grupe Saveza samostalnih sindikata Srbije.<\/p>\n<p><em>Radnik od Agencije dobija zaradu i ima pravo na godi\u0161nje odmore, pla\u0107en prekovremeni rad, da bude za\u0161ti\u0107en na radu. <\/em><\/p>\n<p>Sa druge strane su poslodavci koji su za to da nema ograni\u010denja broja radnika koji mogu u jednoj firmi rade preko agencije, dok je cilj Saveza samostalnih sindikata Srbije da to bude 10 &#8211; 20 %, odsto, ne da bi se stvorila sigurnost radnika koji se zapo\u0161ljavaju preko agencije, ve\u0107 i da bi se za\u0161titili radnici koji rade kod tog poslodavca na neodre\u0111eno.<\/p>\n<p>Ova verzija zakona se se pojavila na kraju javne rasprave pred radnog grupom, bila je potpuno druga\u010dija od one u kojoj su oni kao \u010dlanovi tog tima u\u010destvovali i zato su pripremili niz primedbi. Tako da je jo\u0161 uvek neizvesno kad \u0107e ovaj zakon stupiti na snagu.<\/p>\n<p>Od zahteva sindikata usvojena samo jedna, i to da se supsidijarna odgovornost zameni solidarnom.
